Cary Mayor Harold Weinbrecht wants a do-over in the free-speech case with resident David Bowden, the man who posted a giant sign that reads “Screwed By the Town of Cary” on his home in response to a dispute over damage to his home. The town is already on the hook for $225,000 in this case and Weinbrecht isn’t willing to accept that the town’s sign ordinance regulated Bowden’s speech based on its content. Thus, Cary is asking the judge to alter or amend the ruling in favor of Cary. From the town’s press release:

Weinbrecht said that if Flanagan’s ruling against Cary stands, it will likely become a case of national significance. “I can’t overstate the importance of the outcome of this case,” said Weinbrecht, “and not just for Cary but for every community in every state that seeks to express and preserve its community’s shared values through sign rules.”

If Judge Flanagan again rules against the Town, Cary’s next option would be to take its case to the US Fourth Circuit Court of Appeals in Richmond, VA.
