Think we’ve heard this one before.

One month before CMPD says Kevin Lee McClain, 27, forced his way into a home on Whitehall Drive and shot and killed Manuel Mosqueda-Savedra, 53, a Mecklenburg County court released McClain on a felony drug conviction.

State records indicate that McClain received 30 months probation for his August 13, 2009 conviction. In June of last year McClain was convicted on two misdemeanor drug charges and also given probation, this time 12 months.

To be clear, a big problem with our justice system is that it is clogged out with drug offenders. But it seems to me that if you are going to have drug felonies, convictions on them should rate something more than probation for those already on probation. Otherwise, society sends extremely mixed messages about the rule of law and the punishments associated with breaking those rules.

Might even induce someone to think they could get away with murder.
