Alamance County Attorney Clyde Albright have asked a federal judge to dismiss the Department of Justice’s lawsuit against the county and the Sheriff’s department, citing lack of legal grounds for the suit.

Albright claims the “county is not legally responsible for the actions of the sheriff.” Remember the DOJ lawsuit is based on allegation that the sheriff’s department is targeting minorities as part of its participation in the federal 287(g) program.

With that argument in mind, the sheriff’s department sent its own attorney to federal court in Greensboro to ask for a dismissal, claiming the the department is not a suable entity

Alamance County Commissioner Bill Lashley said earlier in the week “a judge in his right mind would dismiss the case.” Never assume.
