In a split decision, a three-judge panel of the N.C. Court of Appeals this morning ordered a new trial in the case of a 12-year-old girl who sued Blowing Rock for negligence after she suffered injuries while trying to cross a waterfall in the town-owned New Years Creek back in 2004.

In other opinions released this morning:

  • A unanimous three-judge panel reversed a trial court’s ruling and ruled in favor of Nags Head in a dispute over the use of beach-front property after a nor’easter washed away the town road leading to that property.
  • A unanimous three-judge panel reversed a trial court’s order of $33,000 in sanctions against property owners who unsuccessfully challenged a Charlotte development.
  • A unanimous three-judge panel ruled for the second time in the same case against Hillsborough in a dispute over permitting for new construction in a town historic district.
  • A unanimous three-judge panel affirmed a trial court’s ruling against the Enka-Candler Fire and Rescue Department in Buncombe County over a contract dispute with a fired fire chief.
