The N.C. Court of Appeals wants a Stokes County trial court to take another look at a case of a driver charged with driving while impaired after he passed through a driver’s license checkpoint.

The driver contended the arrest violated his constitutional rights. While the appellate judges did not rule that the DWI charge should have been thrown out, the judges did question the trial judge’s procedure in determining that the arrest was constitutional.
