A unanimous three-judge panel of the N.C. Court of Appeals has ruled in favor of N.C. State University in a lawsuit involving a moldy dorm.

A former resident assistant contends the university owes him $150,000 for exposing him to dorm-room conditions that gave him asthma. That medical condition helped lead to his discharge from the U.S. Naval Reserve. But the court ruled against the student because he filed the wrong type of complaint.

In other rulings:

  • A split panel has reversed a trial court ruling that challenged application of Chapel Hill development restrictions.
  • A unanimous panel has upheld a lower court ruling in a case involving a disputed Siler City quarry.
  • A unanimous panel has upheld a ruling favoring the nonprofit owner of the Duke Mansion in a tax dispute with the N.C. Department of Revenue.
