A unanimous three-judge panel of the N.C. Court of Appeals has reversed a lower court and sided with the town of Cary in its dispute with the owner of a Chatham Street billboard. Appellate judges agreed with Cary that the sign owner did not file a timely appeal of the town’s 2006 decision that the billboard had to be removed to comply with Cary’s Land Development Ordinance.

Among other opinions released this morning:

  • A unanimous three-judge panel reversed the N.C. Property Tax Commission and ruled against Davidson County in a dispute over the property values for two textile mills in Lexington and Thomasville.
  • A unanimous three-judge panel affirmed a lower-court ruling in favor of a contractor building a Hendersonville road.
