When you should and shouldn’t use your cell phone — add it to the very long list of things the nanny-staters think they’re more capable of deciding than you are. And now they’ve got the backing of the North Carolina Court of Appeals, whose ruling supports Chapel Hill’s ban on using a cell phone while driving. The ordinance had been challenged by the owner of a towing service.

The court also upheld the town’s ban on handheld and hands-free cell phone use while driving. The decision noted that the case would have been more appropriate if a tow-truck driver had been cited for violating the ban and challenged that case in court, the court stated.

The town’s ban can only be enforced if the driver is stopped for another violation.

The attorney for the towing service says they will appeal to the state Supreme Court.
