Former head of the local NAACP chapter H. K. Edgerton wishes to block Cecil Bothwell from being seated as a member of Asheville City Council. Edgerton claims the avowed atheist is disqualified because Article 8 Section 6 of the state constitution states:
The following persons shall be disqualified for office: First, any person who shall deny the being of Almighty God.
Edgerton is being told, “Nice try,” by Constitutional scholars who say the Supreme Law of the Land trumps local authority and religious tests for office violate the separation of church and state un-clause.
Members of the public have twenty-two hours to come up with something else.
