Elizabeth Poscich owns 205 acres that are about to be confiscated by the Eastern Band of Cherokee Indians for a gaming facility. The tribe claims they can take her land because her mother’s will lacked the required two signatures. Since the court documents did not comply with the Cherokee Code, Principal Chief Michell Hicks says the property automatically reverts to the tribe. To prevent incidents like this in the future, he is suggesting that the tribe offer boilerplate last wills and testaments to all enrolled members. Poscich was scheduled to protest the taking yesterday.
