House Commerce Committee considers HB 1182, Relocation of Easements.
If either party wanted to move an easement, they could institute a special proceeding with the clerk of superior court. The clerk can authorize the relocation of the easement with the servient estate bearing the costs. Rep Mitch Gillespie (R-McDowell) challenged bill sponsor Rep. Phil Haire (D-Jackson) on the security of property rights when any right of way holder can petition the Clerk of court to move easments around on a land owners property. Vote on the bill tied 9 to 9 with committee chair Rep Margaret Dickson (D-Cumberland) breaking the tie and sending the bill on to the House JIII committee.
