A unanimous three-judge panel of the N.C. Court of Appeals upheld this morning a lower-court ruling in favor of former Duke lacrosse coach Mike Pressler. The ruling allows Pressler to move forward with a slander and libel lawsuit against the school and one of its top administrators.

In other new rulings from the appellate court:

  • A split panel affirmed a trial court’s ruling upholding the state’s ability to compel a convicted sex offender to undergo satellite-based monitoring. In the specific case, the defendant contended that the monitoring constituted ex post facto punishment prohibited by the Constitution.
  • A split panel reversed a trial court’s ruling and upheld Hillsborough’s decision to reject a proposed development along the main drive on Churton Street.
  • A unanimous panel reversed a trial court’s ruling and favored Brunswick County in a dispute over junk collection.
  • A unanimous panel reversed a trial court’s ruling and allowed a property owner to proceed with an “inverse condemnation” suit against High Point.
  • A unanimous panel affirmed a trial court’s ruling in favor of Asheville in a sinkhole dispute.
  • A unanimous panel affirmed a trial court’s ruling in favor of Pasquotank County in a zoning dispute.
