NASHVILLE, Tenn. – A bill that would allow free ice cream giveaways is on a rocky road.
The legislation had been approved by Tennessee’s Senate and House but was recalled from Gov. Phil Bredesen’s desk Thursday after dairies raised concerns that it stripped fair trade protections in state law.
The bill was proposed to allow a Dairy Queen owner in Lexington to continue giving free treats to good students.
But when the company celebrated its 100th anniversary last year, she was told that Tennessee was the only state that couldn’t participate in a free ice cream cone giveaway.
The culprit? A 1957 law intended to combat unfair trade practices by the dairy industry.
