The NC Superior Court refused to hear the City of Asheville’s appeal of an August ruling against the city’s claim that the Sullivan acts are unconstitutional. The city is suing both Buncombe County and the state legislature. The laws single out Asheville as the only city in the state that cannot charge differential water rates, cannot use water as an incentive for annexations, and must keep water system revenues in the water department. The laws are so unjust, the only excuse accessible to the public imagination is that somebody has more pull with the courts than the city.
