Don’t really want to go here, but what the public at least has heard cannot be reassuring. The prosecution has thus far given the jury very little with which to convict Demeatrius Montgomery for the murder of two CMPD officers.

Leading with gangsta rap and grieving widows immediately set off alarm bells for me, but I held my tongue. You don’t go with emotion and atmosphere until the end, after your best evidence has prepped the field. But OK, maybe the DA’s office wanted to re-focus with a gut-punch after all the Arvin Fant distractions.

However, today two prosecution witnesses who could not ID Demeatrius Montgomery as the man they saw even talking to the officers? Convenience store video of Montgomery five hours before the murders? Is he on trial for murder or for drinking forties and listening to bad music?

The defense claims the DNA evidence is spotty. We shall see. But if it is, without motive — beyond a rap tune — and without eyewitnesses of any kind they jury would have to reach to return a guilty verdict.

On the plus side, it is early. Maybe the prosecution has a taped confession, maybe something else. And never forget that juries sometimes just decide to ignore the facts. Yet at this moment, I have a bad feeling.
