Music Choice, the Pennsylvania-based provider of music and videos to broadband networks, last week filed a copyright infringement notice with You Tube for Meck Deck’s posting of its Chicks Who Rule ad. As a result, on Friday Google-owned You Tube took down the video which featured a digital image of Brittanee Drexel, the teen who went missing last year in Myrtle Beach during Spring Break.

A copy of the takedown notice is available here.

Music Choice has yet to publicly explain how Drexel’s image came to be used in its ad campaign. But with the DMCA based infringement complaint, Music Choice has demonstrated that it is A) owner, creator, and wholly responsible for the ad B) is aware that Brittanee Drexel’s image was used in that ad.

Stay tuned.

Bonus Gotcha: Now that Music Choice has taken responsibility for the ad under federal law, its execs and lawyers are in a very interesting position.
