A unanimous three-judge panel of the N.C. Court of Appeals has upheld this morning the N.C. Utilities Commission’s decision not to allow environmental activist group NC WARN to intervene in the decision to permit a merger between Duke Energy and Progress Energy. Appeals Court judges agreed that the Utilities Commission had overstepped its authority in ruling that NC WARN lacked standing to appeal its order. But the appellate judges upheld the order blocking intervention in the merger.
