A unanimous three-judge panel of the N.C. Court of Appeals has affirmed a trial court order favoring the Atlantic Coast Conference in its legal battle against departing member the University of Maryland. The appellate judges rejected the school’s argument that sovereign immunity from a lawsuit in its home state should apply to a lawsuit in North Carolina as well.

Among other opinions the Court of Appeals released this morning:

  • A unanimous three-judge panel reversed a trial court and favored the N.C. Department of Health and Human Services in a dispute involving an employee who contended he was unlawfully passed over for an opportunity for promotion.
  • A unanimous three-judge panel affirmed a trial court’s ruling favoring the N.C. Department of Transportation in an Iredell County dispute over property condemnation linked to a road widening project.
  • A unanimous three-judge panel affirmed a trial court’s ruling favoring the N.C. Department of Health and Human Services in a Sampson County case involving the termination of a Medicaid provider.
  • A unanimous three-judge panel affirmed the N.C. Industrial Commission’s decision to award worker’s compensation benefits to a Harnett County school bus driver who developed shoulder problems while doing her job.
