The N.C. Supreme Court has ruled this afternoon against several environmental groups challenging the N.C. Environmental Management Commission’s 2012 ruling on coal ash lagoons. Writing for the court, Justice Sam Ervin IV noted that a 2014 state law dealing with coal ash lagoons renders the court case moot.

Among other Supreme Court opinions released this afternoon:

  • Justices ruled against the Cabarrus County town of Midland in a condemnation case.
  • A 3-3 split within the Supreme Court means Boone wins in its court battle to block a medical clinic in a residentially zoned neighborhood. A trial court had ruled against Boone, but a unanimous three-judge Appeals Court panel ruled in the city’s favor. Because the Supreme Court could not agree in the case, the Appeals Court ruling stands with no precedential value.
