A former Duke Hospital parking lot attendant can proceed with a portion of his lawsuit against Duke University, based on an opinion released this morning from the N.C. Court of Appeals. The ruling from a unanimous three-judge panel reverses a portion of a trial-court order against the attendant, who lost his job in 2008 after a scuffle with a campus police officer.
