Among new opinions released this morning from the N.C. Court of Appeals:

  • A unanimous three-judge panel ruled for a second time — after the case was returned from the N.C. Supreme Court — against the town of Northwest in a legal dispute involving Northwest, the town of Sandy Creek, and contractors who were alleged to have damaged Sandy Creek roads while building a sewer system for Northwest.
  • A unanimous three-judge panel reversed part of a trial-court ruling and ruled in favor of a patient who sued Duke University Health System for medical malpractice. The patient sued after alleging that a Duke doctor removed the wrong rib during a surgery.
  • A split 2-1 panel ruled in favor of Duke University in a dispute involving two students suspended from school because of a loud off-campus party.
  • A unanimous three-judge panel sided with the City of Wilson in a legal battle over condemnation for a utility easement.
  • A unanimous three-judge panel upheld a Johnston County rape verdict, even though the appellate judges accepted the defendant’s argument against DNA evidence in the case.
