Among the other N.C. Supreme Court opinions released today:

  • Justices unanimously reversed an Appeals Court ruling ordering a new trial in the case of a 12-year-old girl who sued Blowing Rock for negligence after she suffered injuries while trying to cross a waterfall in the town-owned New Years Creek back in 2004.
  • Justices split 4-3 in ruling that a clerk of Superior Court does not have the authority to determine the “reasonableness” of attorney’s fees a trustee-attorney in a foreclosure proceeding pays to himself in addition to his trustee’s commission. The ruling affirms a split Appeals Court ruling in an Alamance County case.
  • Justices split 4-3 and generated two separate dissenting opinions in a Harnett County case involving the trial court’s ability to terminate parental rights in a juvenile case. The majority affirmed the Appeals Court in the case.
  • Justices voted 6-1 to reverse the Appeals Court in a Forsyth County case involving a Fourth Amendment claim of an unreasonable search. The high court ruled law enforcement officers did not violate the defendant’s rights when they searched his car after arresting him for carrying a concealed gun.
