In last year?s Drought Management Act, despite assurances from bill sponsors, questions remained if private wells were indeed protected from government interference. Daren Bakst pointed this out in a Spotlight report after the bill was enacted. 

To ensure that private wells are excluded from government regulation in a water shortage emergency Rep David Lewis (R Harnett) has filed House Bill 1429.  The bill clarifies that water conservation measures imposed by a local government do NOT authorize the regulation of water use from ? a well outside of its jurisdiction, a well not connected to its water system, or any other private well.?  The bill is scheduled for a hearing before the House Water Resources and Infrastructure Committee next Tuesday, May 12 at 2:00.
