Manhattan Institute has just done a gigantic public service in releasing this paper analyzing the economic and legal issues involved with the so-called Employee Free Choice Act. Epstein observes that while most of the attention has been focused on the “card check” aspect of this atrocious piece of legislation, its mandatory arbitration feature is at least as damaging.

The paper, which includes Q and A that took place when Epstein delivered the paper last year, is long, but reading it will be worth your while if you want to savor a truly brilliant scholar’s analysis.

Obama and Epstein were colleagues at the University of Chicago Law School. It would be delightful to see Obama drawn into debating Epstein’s ideas, but of course that’s the last thing he wants to do.
