Since the Supreme Court’s Kelo ruling a host of states (excluding NC of course) have taken substantive action to protect property from economic development eminent domain issues.
Delaware has a new law in place
Alabama signed one yesterday.
California, Illinois, Michigan, New Jersey, New York, Oregon, Pennsylvania & Texas all have bills pending this year.
But remember our friend Ellis Hankins of the NC League of
Municipalities admonition, “that kind of abuse just won’t happen in NC.” So, do we believe “I like Forced Annexation” Hankins or do we want constitutional protections?
Paul Farmer, executive director of the American Planning
Association, said eminent domain for private projects can REVITALIZE cities. “It should remain a tool that would clearly not be used very often,” he said.
It still boggles my mind that there are Americans who beieve this.
