No doubt you’ve heard by now Superior Judge Richard Hobgood has ruled unconstitutional North Carolina’s law banning teacher tenure.

Locker Room’s Terry Stoops notes it’s yet another day, another Hobgood ruling. It could be yet another day, another ruling by a higher court judge if the state carries through with Sen. Phil Berger’s threat to appeal.

Stoops is right –the ball is now in the Republicans’ court—he suggests they “take a breath and regroup” for the 2015 session. That’s assuming they still control the legislature in 2105. In the meantime, I’d like to see them defend the law as an election issue, if Hobgood’s ruling is indeed —as Berger put it—-“a classic case of judicial activism.”
