Anyway, what the report says is that, based on a comparison of the language in speech and “harassment” codes in place throughout the UNC system with the language in similar policies that have been struck down on First Amendment grounds in cases around the US, most UNC campuses have policies that are wide open to challenge. It seems to me that the sensible thing for UNC to do would be to treat this report good free advice. If a consultant went to each UNC campus and did a study showing that there were fire hazards in many of the buildings, would it be reasonable for UNC to reply, “well, there haven’t been many fires yet”?
