In a 2-1 decision, a panel of the N.C. Court of Appeals has ruled this morning against plaintiffs challenging the state lottery act.

Judges James Wynn and Robert Hunter agreed that the lottery legislation approved in 2005 was not a revenue bill requiring action on three separate days. Judge Ann Marie Calabria dissented. 

The case ? Heatherly v. State ? could head to the N.C. Supreme Court.
