I don’t read June Atkinson’s latest comments on the public school leadership debate the same way Ryan Teague Beckwith does.

[I]n a statement
yesterday, Atkinson seemed to open up that possibility, saying the
issue will not be resolved “until it is challenged in the judicial
system or the Constitution is changed.”

The “possibility” to which Ryan refers is a lawsuit Atkinson would file to clarify who leads the state’s public school establishment. Ryan infers from the statement that Atkinson is more open now to a legal challenge that she openly rejected in past statements.

That might be true, but Atkinson uses a passive voice ? “until it is challenged” ? that seems consistent with her statements that she is not the one who’s going to file suit. Perhaps she’s offering a strong hint that she would not stand in the way of anyone else filing suit.
