Jacob Holm is going to get over $1 million from Buncombe County taxpayers, and likely more from the One North Carolina fund. That is good, as I wouldn’t think of purchasing a wipe without government help. Most impressive in the contract, besides the usual typoes that leave me wondering how well the terms were researched, is the list of events justifying exiting the contract. There are seven. Government failure accounts for four, union interests and acts of God claim one each, and the final one is a catchall:

  1. government moratorium;
  2. delay in obtaining any governmental or quasi?governmental approvals, permits
    or certificates, despite reasonable efforts by Jacob Holm to obtain same;
  3. enemy or hostile governmental or terrorist action;
  4. act of God, including but not limited to hurricane, tornado, snowstorm,
    windstorm, earthquake or flood, fire or other extreme weather conditions or other casualty;
  5. strike, lockout or a labor dispute involving entities other than Jacob Holm which
    causes Jacob Holm an inability to obtain labor or materials;
  6. delay in funding from any state or local government incentive to or for the
    benefit of Jacob Holm, or;
  7. any other event, other than normal business exigencies, which is beyond the
    reasonable control of Jacob Holm
