A unanimous three-judge panel of the N.C. Court of Appeals has affirmed a Wake County trial court ruling favoring the N.C. State Board of Education in a dispute involving operators of a proposed N.C. Virtual Charter School.
Among other appellate court opinions released this morning:
- A unanimous three-judge panel rejected a challenge of the N.C. Department of Health and Human Services’ decision to award a certificate of need for two new “gastrointestinal endoscopy” rooms in Gaston County. Competing medical providers had challenged the granting of a CON to Greater Gaston Center LLC.
- A unanimous three-judge panel affirmed a trial court ruling favoring Winston-Salem State University in a compensation dispute with a university staff member.
- In an unpublished opinion with no value as a precedent, a unanimous three-judge panel affirmed a Henderson County trial-court ruling against a man who challenged North Carolina’s felony firearms law as unconstitutional when applied in his case.
- In another unpublished opinion, a unanimous three-judge panel upheld a ruling from the N.C. Industrial Commission against a man who claimed a state Highway Patrol trooper used excessive force against him in 2008 in Duplin County.
