A unanimous three-judge panel of the N.C. Court of Appeals has affirmed this morning a lower-court ruling blocking Charlotte’s Myers Park Homeowners Association from challenging a new dorm, parking deck, and athletic building for neighboring Queens College.

In other opinions released this morning:

  • A unanimous three-judge panel affirmed a lower court’s ruling that a doctor and his patients cannot sue Moore Regional Hospital as a “public utility” in an effort to challenge the hospital’s denial of hospital staff privileges to the doctor.
  • A three-judge panel agreed — though judges did not sign on to a unanimous opinion — to reverse a trial court and rule that the victim of a 2008 botched surgery at Duke University Medical Center can proceed with a medical malpractice suit against Duke and some of its doctors.
  • A unanimous three-judge panel affirmed a lower court ruling against the Swain County sheriff in a wrongful termination lawsuit involving a former county detention officer.
