The North Carolina Bar is after attorney and state lawmaker Nick Mackey for failing to pay his taxes. OK.

Mecklenburg County Superior Court Judge Linwood O. Foust had property seized by the IRS for failure to pay income taxes, according to county property records. A relative of the judge then bought the property back from the government at auction.

The IRS took its action in 1996. Foust has been a member of the NC Bar since 1975. In 1988 the state bar censured Foust for failing to close a home loan proceeding in a timely manner and failing to forward over $1000 to his clients. In 1994 the bar reprimanded Foust for his participation in a client referral scheme. There is no public record of state bar action in response to the IRS actions.

You might recall Judge Foust from the Holly Mitchell fiasco. Mitchell has been convicted, escaped from prison, re-arrested, and released since Judge Foust initially set him free in 2007 against the advice of prosecutors, CMPD, and probation officers.

Bonus Observation: Judge Foust still owns another home in East Charlotte that was also seized by the IRS from him and his then-wife for non-payment of income taxes. In 2006 Foust received a $111,500 mortgage on that property from the State Employees Credit Union, according to county records.
