A unanimous three-judge panel of the N.C. Court of Appeals has ruled in favor of Broadus E. Hill III, who challenged Wilmington’s ordinances limiting his ability to construct a garage apartment on his property.
The appeals court agreed with a trial judge’s September 2006 ruling that part of the Wilmington Land Development Code is unconstitutional.
