In the latest batch of opinions the N.C. Court of Appeals has released this morning:
- A three-judge panel ruled 2-1 to affirm a trial court ruling against Cary in a dispute over $600,000 in school fees paid by builders in the 143-acre Cameron Pond subdivision. The dissenting judge agreed with the reasoning in the majority opinion but would have preferred to dismiss Cary’s appeal before ruling on its merits.
- A unanimous three-judge panel sent a lawsuit back to the trial-court level to determine whether the Rutherford County Airport Authority can collect attorney’s fees in a dispute with its former airport manager.
- A unanimous three-judge panel affirmed a lower-court ruling against the Union County village of Wesley Chapel, which had tried to block a property owner from building a shooting range on his property.
- A unanimous three-judge panel affirmed a ruling from the N.C. Industrial Commission about the size of payment N.C. State University owes a horse owner whose horse died from dehydration after staying at NCSU’s Equine Educational Unit.
- A unanimous three-judge panel reversed a lower-court ruling in a dispute over road access to homes on Grandfather Mountain.
