These Terms and Conditions govern your use of the websites, digital properties, text messaging programs, forms, events, and related services operated by the John Locke Foundation, including Carolina Journal, the North Carolina History Project, and other Locke-controlled properties (collectively, “Locke,” “we,” “us,” or “our”). 

By accessing or using our websites or services, you agree to these Terms and Conditions. 

1. Use of Locke Websites and Services 

You may use our websites and services only for lawful purposes. You agree not to use our websites or services in any way that could damage, disable, overburden, or impair our operations, or interfere with any other person’s use of the websites or services. 

You agree not to attempt to gain unauthorized access to any portion of our systems, accounts, servers, or networks. 

2. Intellectual Property 

Unless otherwise indicated, the content on our websites, including text, graphics, logos, videos, images, documents, and other materials, is owned by or licensed to Locke and is protected by applicable intellectual property laws. 

You may view, download, or print content for personal, noncommercial use, provided that you do not remove any copyright, trademark, or other proprietary notices. Any other use requires prior written permission from Locke unless otherwise permitted by law. 

3. Third-Party Links and Services 

Our websites may include links to third-party websites, platforms, or services. Locke does not control and is not responsible for the content, terms, privacy practices, or availability of third-party sites or services. 

4. Donations, Event Registrations, and Transactions 

Donations, ticket purchases, event registrations, and other transactions made through our websites or services may be processed by third-party providers. By submitting payment or registration information, you agree to provide accurate and complete information. 

Locke reserves the right to refuse, cancel, or limit any transaction or registration if necessary to protect our operations, comply with law, or address suspected fraud or misuse. 

5. Event Refunds 

Locke may offer refunds for foundation-sponsored events in accordance with the applicable event terms or event-specific refund policies. Unless otherwise stated for a specific event, refund requests should be made in advance of the event or promptly after the event if a participant is dissatisfied. 

6. Disclaimer of Warranties 

Our websites and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Locke disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. 

We do not warrant that our websites or services will be error-free, secure, or free from viruses or other harmful components. 

7. Limitation of Liability 

To the fullest extent permitted by law, Locke shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, our websites or services.

You agree to indemnify and hold harmless Locke and its officers, directors, employees, agents, and affiliates from and against claims, liabilities, damages, losses, and expenses arising out of your violation of these Terms and Conditions or your misuse of our websites or services.

We may update these Terms and Conditions from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of our websites or services after changes are posted constitutes your acceptance of the updated Terms.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles. 

11. SMS Terms and Conditions 

This section applies if you provide your mobile phone number and agree to receive text messages from Carolina Journal, the John Locke Foundation, or another Locke-controlled program. 

By providing your phone number and opting in, you agree to receive promotional and marketing messages, donation solicitations, notifications, event-related messages, and customer service communications from Locke or Carolina Journal, as applicable. 

SMS consent 

Consent to receive text messages is not a condition of purchase or donation.

Message frequency varies.

Opt-out 

You may opt out of text messages at any time by replying:
