Bannon says Nifong, in his questioning, asks Meehan if he felt Nifong had ever asked him to withhold evidence. Bannon says he seemed to be saying that he never “uttered the magic words” to withhold evidence, so then there was no problem.

Judge Smith asked if there were any other motions for relief that the defense wanted at this time. Bannon said the defense would have to discuss that.

Meehan was discharged as a witness. Bannon said they would like to peruse the transcript of the day’s testimony first.

Now discussing Dec. 16 News & Observer story about the Dec. 15 hearing. “Did you intend to report less than the full truth?” Nifong is quoted by the paper as asking Meehan. Nifong said he had only heard about the additional DNA on the Wednesday before the hearing, but he is quoted as “amending” his comments to say that he did in fact know of the info but didn’t want to “drag anyone through the mud.”
