As readers of this blog or Carolina Journal will know, there’s been a long running dispute between blogger Steve Cooksey and the North Carolina Board of Dietetics/Nutrition. The Board claimed that, through his blog, which offered personal advice about the Paleo diet and how he’d used it to reverse his own diabetes, Cooksey was offering nutritional counseling without a license.
Cooksey sued the Board, maintaining his blog was protected free speech, but a federal district judge dismissed the case saying that Cooksey’s blog wasn’t protected. So it was good news yesterday when the 4th Circuit Court of Appeals reversed that decision, allowing his lawsuit to go ahead. That’s at least a small victory for free speech.
