Symptomatic of losing the forest for the trees, and losing principles in a deluge of legalese, the Buncombe County Commissioners were asked to put off instituting their new zoning ordinance. The latest attempt was voided by the courts when it was found that the commissioners had not given sufficient notice of their intent. The courts were not concerned that this is supposed to be a nation of property rights, or that over 60% of voters opposed countywide zoning in the last referendum. What’s more ludicrous, the county’s legal counsel was asking for an extension because it had been discovered that the two townships that were zoned prior to the attempt to implement countywide zoning also failed to provide sufficient notice.
