Nancy Pelosi and her ilk fear and hate the constitutionality question like a vampire fears and hates garlic (at least, I think that’s the tale). If Americans started to take the Constitution seriously again, there would be no end to the troubles for the big government crowd. Imagine if people came to understand that the culprits in the recent economic debacle, especially Fannie Mae, Freddie Mac, and the Community Reinvestment Act, would all have been laughed at as far outside of the government’s proper authority if they had been suggested to, oh, Jefferson or Madison. They might start to demand that Congress busy itself in repealing unconstitutional laws and programs rather than passing new ones.
