With NC State Board of Elections Executive Director Karen Brinson Bell’s appearance before the NC Senate Elections and Redistricting committee yesterday, this is a good time to remember that a federal judge found that she had violated the Equal Protection Clause of the 14th Amendment to the US Constitution last fall. The section starts on page 57, but here is the bottom line on page 59:
Because Plaintiffs have demonstrated a likelihood of success on the merits in proving arbitrary and disparate treatment may result under the Receipt Deadline Extension, this court finds Plaintiffs have established a likelihood of success on the merits of their Equal Protection claim.
