Witt is asking Himan about his grand jury testimony. This seems dangerous in that Himan yesterday seemed to think there was no case, so the question arises: What did he tell the grand jury that made them issue indictments?

He says Nifong never asked him to withhold evidence from the grand jury and that he didn’t discuss his grand jury testimony with Nifong. However, they did have the now-famous “we’re f—-d” meeting, which surely gave Himan the idea that maybe they didn’t have a very strong case using actual, you know, evidence. Again, what exculpatory facts that were known to Himan, Gottlieb and Nifong, facts that were so exculpatory that they prompted Nifong’s “were f—-d” comment, were not told to the grand jury.

The redirect on this will be interesting.
