In the meeting of Asheville City Council tonight, council was presented with a problem. Everybody wants infill development and smart growth, but a person renting out their garage was too much for one neighborhood to handle. When they were discovered by the city, with much effort, the person decided to toss out their renter and parcel off a portion of the land not occupied by the house. It may have been a cost-recovery scheme. Anyway, the neighbors didn’t like that because then that parcel could have a house with an accessory rental built on it. Council wanted to try to restrict the land from ever having more than one housing unit on it, but City Attorney Bob Oast informed them conditional zonings must be initiated by the property owner. In the end, council approved subdividing the lot and keeping the tenant tossed by a 4-3 vote, so the matter will be subject to a second reading.
