Tara Levicy, the SANE nurse who examined Mangum, is taking the stand. Sexual Assault Nurse Examiner at Duke Medical Center. Has a bachelor’s degree in nursing. Been a SANE nurse since March 2006.
Saw Crystal Mangum around 7 a.m. Said she was on a stretcher. Was alone. Freedman is questioning her.
Said she was asked to do a sexual assault exam on her. Said she didn’t smell any alcohol on her. Was discharged sometime that afternoon. Was with her for five or six hours. Assisted Dr. Manley in doing the SBI kit.
Freedman: Did she tell you what had happened to her? Levicy: She said someone ejaculated into her mouth. Freedman: Not in detail. Was she consistent in her version in the time she was with you? Did her version ever change in that six or seven hours. Levicy: No.
Freedman: Was she consistent with someone who had been assaulted? Levicy: Based on what she told me she was. Freedman: Did she tell condoms were used? Levicy: She said they were not. Freedman: Do victims often know whether condoms are used in an assault? [Man, he’s trying the case again, trying to prove there was an actual assault.]
Freedman…..is……so…..slow….wish…..he’d……pick…..up……the…..pace.
Man, she’s a slow reader. She’s reading her interview she had with Himan and Gottlieb. She says it’s a summary so there’s stuff missing.

Katherine Jean now questioning: Did you come voluntarily today or were you subpoenaed? Levicy: I was subpoenaed.
Jean: Go to the report you and Dr. Manly prepared. Points to where it says “did not use a condom.” Tells her to go to another page where it says “no condoms used.” Then on same page choice was checked by Levicy that no condom was used. So, reading this report one would have to conclude that no condom was used, correct? Levicy: Yes.
No more questions.
Freedman again on redirect. Directs her to a page that says Mangum said no condom was used but “not sure.”
Jean: But you’re reading from a summary made in Jan. 2007. In your report the night of the incident, you said no condom was used.
