Witt: What steps did you take on the defense’s Dec. 13 motion? Nifong: “My first reaction was, ‘They don’t have this?'” Says they seemed to be looking for evidence of an agreement between me and Meehan to conceal this. They were looking for phone logs, etc. Points out Bannon said the only reason they didn’t accuse me of this was they didn’t have any evidence.
Williamson: “Not at the time.” Whoa!
Witt: Did you discuss with Meehan what he would say in court about this? Nifong: No, there had been no agreement so I didn’t need to.
Witt: Did you ever say I’m sorry I didn’t provide it? Nifong: No, I didn’t, but they had discovered they hadn’t gotten it on their own and so they got it.
Again, isn’t Witt supposed to be helping his client?
On Dec. 13 was the first time he realized they hadn’t gotten the non-player DNA report until Oct. 27, Nifong says. “It was something I hadn’t thought about until I got the motion on Dec. 13 and I said, ‘Oh, crap.'”
