Witt reads Bannon’s saying before the court that any reasonable person would know that this was exculpatory evidence and says, “And you don’t think that’s accusatory?”

Bannon says it wasn’t accusatory, just stating the facts.

Witt now gets Bannon to read the part where Meehan says he doesn’t consider the report he sent to Nifong a final report. He then asks him to read Meehan saying “I don’t remember him asking me specifically to write it that way.” expressed his privacy concerns, etc. He reads Meehan saying, “He didn’t ask me to specifically exclude those, OK.”

Bannon kept reading long after Witt wanted him too, getting in some of his own questions to Meehan, and then said, “I’m sorry,” but you could see he didn’t mean it. Sly dog.

Now he’s sighing. Chin up, Brad. It’ll be over soon.

No further questions.

Brocker redirect: Asks Bannon to read where Bannon asked Meehan whose privacy it would have violated if he had just reported the unnamed DNA findings. Meehan said that alone wouldn’t have violated anyone’s privacy. He also gets Bannon to reiterate that Judge Smith’s order asked for everything, not just a partial report.
